These Terms and Conditions govern all repair, servicing, tape conversion, and hardware sales provided by Thurrock Digital. The latest authoritative version is published at www.thurrockdigital.co.uk.
1. Business Information & Definitions
Thurrock Digital is an independent, non-VAT registered sole trader business operating in Stanford-le-Hope, Essex, United Kingdom.
- "We" / "Us" / "Our" / "Thurrock Digital" refers to Thurrock Digital, its owner, employees, and any authorized third parties acting on our behalf.
- "You" / "Your" / "Customer" refers to the individual or entity making an enquiry, booking, or purchasing Services from Us.
- "Device" / "Equipment" refers to any smartphone, tablet, computer, games console, audio/video tape, media, or other physical hardware provided to Us for Service.
- "Service" / "Services" refers to any inspection, diagnostic testing, board-level repair, hardware maintenance, software configuration, tape conversion, or on-site support carried out by Us.
2. Acceptance & Basis of Contract
2.1. Agreement: By engaging Our Services, leaving a Device with Us, purchasing hardware, or booking an appointment, You agree to be legally bound by these Terms and Conditions.
2.2. Consumer Rights: If You deal with Us as a consumer, nothing in these terms excludes, restricts, or modifies any statutory rights You hold under the UK Consumer Rights Act 2015.
3. Pricing, Diagnostic Fees & Payments
3.1. Quotations: Initial quotes issued prior to physical disassembly or inspection are estimates based on supplied information. If additional faults, component failures, or parts requirements are identified during work, We will pause the Service and seek Your explicit approval of any revised quotation before continuing. If a revised quotation is neither accepted nor declined within 7 calendar days of transmission, the Device will be moved to complete status and Section 7 storage terms will apply.
3.2. Diagnostic Service & Fees: Diagnostic testing is a standalone, billable Service requiring labor, bench time, and technical investigation. Diagnostic fees pay for the technical labor and bench investigation spent evaluating the Device, not a guaranteed repair outcome. Diagnostic fees are non-refundable and strictly additional to any subsequent repair costs (they are not deducted from repair totals, even if the Device is unrepairable or You decline repair):
| Device Category | Diagnostic Fee |
|---|---|
| Desktop PCs & Laptops | £30 |
| Android Smartphones & Tablets | £50 |
| Apple Products (iPhones, iPads, MacBooks, iMacs) | £50 |
3.3. Payment Terms: Full payment for all Services, diagnostics, and fitted parts is due prior to or at the time of Device collection/delivery. We accept Cash, Business Bank Transfer, and Credit/Debit Card payments.
3.4. Lien: We reserve the legal right to retain physical possession of Your Device under a possessory lien until all outstanding invoice balances (including diagnostics and storage) are settled in full.
3.5. Pre-Service Testing Limitations & Pre-Existing / Hidden Faults:
- Incomplete Testing: Where a Device is delivered to Us in a non-functional state (including, but not limited to, a black/unresponsive screen, total power failure, boot looping, or liquid damage), We are unable to perform complete pre-repair diagnostic testing.
- Pre-Existing & Consequential Damage: You acknowledge that underlying faults, prior unrecorded physical/component damage, or previous repair attempts may only become apparent during disassembly or after restoring power to the Device.
- Exclusion of Liability for Undiscovered Issues: Thurrock Digital accepts no liability for pre-existing hidden faults, secondary component failures, or pre-existing defects that could not reasonably be identified prior to physical teardown. Opening or servicing a damaged or non-working Device carries an inherent risk of revealing or worsening latent structural or electronic failure; You agree that such occurrences do not constitute poor workmanship or damage caused by Us.
4. Personal Data & Data Loss
4.1. Customer Backup Responsibility: Hardware diagnostic and repair operations carry an inherent risk of data corruption or total loss. You are solely responsible for creating complete, recoverable backups of all personal files, media, and software stored on Your Device prior to handing it to Us.
4.2. Exclusion of Data Liability: To the maximum extent permitted by UK law, Thurrock Digital accepts no financial or legal liability for lost, corrupted, or inaccessible data, software licenses, or photos, nor for any third-party data recovery fees incurred.
5. Parts, Serialization & Technical Restrictions
5.1. Existing Warranties: Submitting a Device to Us may void existing manufacturer or extended third-party warranties. It is Your responsibility to check warranty coverage prior to booking.
5.2. Replacement Components: We utilize high-quality genuine, OEM refurbished, or premium aftermarket replacement parts. If You require brand-new, original manufacturer parts exclusively, You must state this at booking (additional fees and longer lead times will apply).
5.3. Hardware Pairing & System Messages: Modern electronics (especially Apple hardware) pair specific components (screens, batteries, cameras) to the logic board at manufacture. Replacing these components—even with genuine parts—may trigger system notifications (e.g., "Important Display Message") or disable secondary features (e.g., True Tone, Battery Health metrics). These are standard manufacturer software behaviors and do not constitute repair defects.
5.4. Software Updates: Subsequent operating system or firmware updates pushed by manufacturers are outside Our control and may alter component functionality or revive notification warnings. We accept no liability for post-repair restrictions resulting from official software updates.
5.5. Liquid Ingress Protection: Opening any water-, dust-, or splash-resistant Device compromises factory seals. We cannot guarantee that any Device will retain its original liquid or dust ingress protection levels following Service.
6. Repair Warranties
6.1. Coverage Periods: Our warranties start on the date invoice payment is received:
- Standard Component Repairs & Replaced Parts: 90 calendar days (parts and labor).
- Board-Level / Micro-soldering Repairs: 60 calendar days (labor and micro-soldering work).
- Pre-Owned Hardware Sold by Us: 90 calendar days (hardware failure only).
6.2. Scope of Coverage: Our warranty strictly covers the recurrence of the exact original fault or the failure of specific replacement components supplied and installed by Us.
6.3. Warranty Exclusions: Our warranty is explicitly voided by:
- Accidental or deliberate physical damage, drops, pressure marks, cracks, or liquid exposure/corrosion.
- User-supplied parts fitted by Us (labor is covered, but no warranty is provided on parts supplied by the Customer).
- Software issues, malware, operating system corruption, jailbreaking, or custom firmware flashing.
- Subsequent repair attempts, disassembly, or modifications performed by You or any third party.
6.4. High-Risk Repairs: Where a Device presents severe pre-existing damage (e.g., severe board heat degradation or heavy liquid exposure), We will notify You of heightened repair risks beforehand. If You instruct Us to proceed, You do so entirely at Your own risk, and We accept no liability for total Device failure during the attempt.
6.5. Non-Transferable: Warranties are tied to the specific IMEI/Serial Number in our database and are non-transferable to subsequent owners.
7. Collection, Storage & Abandoned Goods
7.1. Collection Window: You must collect Your Device or media within 3 calendar days of being notified that work or diagnostics are complete.
7.2. Storage Charges: Items uncollected after 3 calendar days will incur a mandatory storage charge of £10 per calendar day.
7.3. Legal Notice of Abandonment (Torts Act 1977) & Data Protection: Pursuant to the Torts (Interference with Goods) Act 1977, if a Device or media remains uncollected or unpaid for 28 calendar days following initial completion notification, We reserve the legal right to dispose of, recycle, or sell the item to recover outstanding repair costs, diagnostic fees, and accrued storage charges. Prior to any disposal, recycling, or resale under this section, We reserve the right to wipe, sanitize, or physically destroy all internal storage media to protect Customer data privacy in compliance with UK GDPR and the Data Protection Act 2018.
8. Media & Tape Conversions
8.1. Tape Repair Charges: Tapes requiring splicing, mechanical casing repair, or structural repair to enable playback incur an additional mandatory fee of £10 per tape.
8.2. Blank & Refused Media: Tapes found to be blank, unreadable, or containing copyrighted, violent, or illegal material will be refused service and charged an inspection fee of £5 per tape.
8.3. Digital File Retention: Digitized files are stored locally for 30 calendar days post-conversion as an interim backup, after which they are permanently and securely deleted. You must inspect and verify digital files upon delivery.
8.4. Media Collection: Original media must be collected within 3 calendar days of completion notification, after which storage fees and abandonment rules in Section 7 apply.
9. On-Site & Remote Visits
9.1. On-Site Service Terms: On-site visits at Customer premises are billed at our agreed hourly rate (minimum 1 hour charge, followed by 30-minute increments). You must provide safe physical access and an appropriate workspace.
10. Limitation of Liability
10.1. Statutory Exceptions: Nothing in these terms excludes or limits Our liability for death or personal injury caused by Our negligence, or for fraudulent misrepresentation.
10.2. Financial Liability Cap: Subject to Section 10.1, Our maximum cumulative financial liability for any direct claim arising out of or related to our Services shall not exceed the actual invoice price paid by You for the Service, or the fair market value of the Device prior to repair (whichever is lower).
10.3. Indirect Losses: Under no circumstances shall Thurrock Digital be liable for indirect, special, incidental, or consequential losses, including loss of profits, business revenue, goodwill, or opportunity.
11. Governing Law & Jurisdiction
11.1. Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the English courts.
